Your Medical Records Free for a VA Claim — From Every Provider

Texas puts an obligation on health care providers and facilities to give ONE COMPLETE COPY of your medical, mental health AND BILLING records FREE OF CHARGE, PER PROVIDER, when the records are for a VA disability compensation or pension claim. LATER SUPPLEMENTAL RECORDS ARE ALSO FREE on request. Records charges are one of the real costs of building a claim, and this removes them. You need a statement or document from the accredited representative or agency showing the records are for the claim.

What this benefit is

  • ONE COMPLETE COPY of MEDICAL, MENTAL HEALTH AND BILLING records, FREE OF CHARGE, PER PROVIDER.

  • The records must be to support a VA disability compensation or pension claim under 38 U.S.C. §1101 et seq. or §1501 et seq.
  • You need A STATEMENT OR DOCUMENT FROM THE ACCREDITED REPRESENTATIVE OR AGENCY showing the records are for the claim.
  • The obligation is on TEXAS HEALTH CARE PROVIDERS AND FACILITIES under Health & Safety Code ch. 161, subch. M.
  • Any patient or former patient may use it, or their attorney or authorised representative.

How to claim it

  1. 1Get the statement from your accredited representative or agency FIRST — the Texas Veterans Commission can give you one.
  2. 2Send a written request to each provider separately. The free copy is per provider.
  3. 3Ask for medical, mental health AND billing records; billing records are often the ones that establish dates.
  4. 4If more records accumulate later, ask again — supplements are free too.
  5. 5If a provider tries to charge, point them at Health & Safety Code ch. 161, subch. M.
