How to claim it

  1. 1Apply to your own licensing board — there is no central office. The act binds every agency, board and commission with licensing authority.
  2. 2If you hold a current licence elsewhere and are transferring in on orders, apply BEFORE the move: §4100.8 lets you file in advance of the actual transfer or discharge, and the board must decide within 30 days where the other licence is in good standing and reasonably equivalent.
  3. 3Send your DD214 or training transcripts and ask the board to apply the training "in the manner most favorable" under §4100.4 — that is the statutory phrase.
  4. 4A military spouse should cite §4100.5 and say plainly that they left employment elsewhere to accompany the servicemember. That is one of the four conditions in the statute.
  5. 5If a board has no rule implementing the act, say so: §4100.4(C) and §4100.5(D) deem such a board in violation.

CorrectionThe licensing fee waiver is not a veterans' waiver. §4100.8(D) waives the application fee and the first-period licence fee for "active duty military personnel and their spouse". A discharged veteran with no active-duty status gets the credit-for-training provisions, not the fee waiver.
Worth knowing§4100.6 is the deployment provision: while deployed on active duty, a licence may be renewed without paying dues or fees and without continuing education in the circumstances listed, and may be continued for at least one year after discharge from active duty.
Worth knowingThe military spouse route in §4100.5 has a residency condition that is easy to fail: the servicemember must be on active duty within the state, or have claimed permanent residency here for the six months before assignment to active duty or during it.
