How to claim it
Deadline: When the attachment, execution or disclosure is served on you- 1Say the words. Exempt property is exempt from attachment and execution, but the section does not apply itself — the exemption is claimed by the debtor in the proceeding, and property that has been fraudulently conveyed is outside it whatever its type.
- 2Name the right limb. Subsection 13 groups disability benefits and pensions, and paragraph B is simply "a veterans’ benefit". Paragraph A covers social security, unemployment compensation and public assistance, including tax refunds attributable to the earned income tax credit and any child tax credit.
- 3Keep the money identifiable. A benefit is easiest to protect where it can be traced; once it is mixed into general funds the argument shifts to the separate $3,000 deposit-account exemption instead.
- 4Use the deposit-account route where a bank account has been frozen: the section exempts an interest in cash or in deposit or other financial-institution accounts up to $3,000, and the plaintiff, defendant or other account owner may file an ex parte motion for dissolution or modification in the court that entered the judgment or prejudgment order.
- 5Claim the higher residence tier if you are inside it — $160,000 rather than $80,000 — where minor dependants have their principal residence with you, or where you or a dependant is 60 or older, or is physically or mentally disabled and because of that disability cannot engage in substantial gainful employment, the disability having lasted or being expected to last at least 12 months or to result in death.
- 6Note that "dependent" is defined for this article to include a spouse whether or not actually dependent, which widens the higher residence tier considerably.
- 7Two limits sit on the residence exemption and are easy to miss: it does not apply to judgments based on torts involving other than ordinary negligence, and the amount claimed is limited to the exemption in effect on the date the lien was recorded, not the date you claim it.
- 8Take advice before a bankruptcy filing. The section is written to operate both outside and inside a federal bankruptcy proceeding and the timing rules differ between them.
