The Wounded or Disabled Veterans Programme — a Coordinator, and Data-Sharing With the VA and Defense

What this benefit is

A statutory programme whose job is to ease the transition from active service and to ensure wounded or disabled veterans receive the federal, state and private benefits they are entitled to. The commissioner designates a wounded or disabled veterans coordinator for the Commonwealth. The department is required to enter data-sharing agreements with the United States Department of Veterans Affairs and the Department of Defense to get timely address and medical status information.

  • No payment is made under this section. Its value is a route to a designated official and a statutory duty to chase entitlement rather than merely publicise it.
  • The programme accepts and expends money appropriated by the General Assembly and money from any other source including donations and grants; the section itself appropriates nothing.
  • The duty in subsection (1)(b)2 — to ENSURE veterans receive the benefits they are entitled to — is the operative language and is stronger than the outreach duty in subsection (2)(a).

How to claim it

  1. 1Ask for the post by its statutory name. Subsection (1)(c) requires the commissioner to designate a wounded or disabled veterans coordinator for the Commonwealth, so there is a specific person rather than a general enquiry line.
  2. 2Quote the duty rather than the outreach. Subsection (1)(b) sets two objects: to ease the transition from active service, and to ENSURE that wounded or disabled veterans receive the federal, state and private benefits to which they are entitled.
  3. 3Private benefits are inside the section, not just federal and state ones. The programme is required to collaborate with federal, state AND PRIVATE agencies that provide services.
  4. 4Use the data-sharing duty if the department says it cannot find your record. Subsection (4) requires the department to enter into data-sharing agreements with the United States Department of Veterans Affairs and the Department of Defense to obtain timely information about a Kentucky wounded or disabled veteran’s address and medical status.
  5. 5Your consent is the gate on personal information, and the protection is real. Under subsection (5) the coordinator or a designee may obtain personal information only with the veteran’s consent and for the sole purpose of implementing the programme, and the information is not subject to public disclosure under KRS 61.878.
  6. 6Ask about education and honours as separate components. The programme must provide guidance through conferences, seminars and training workshops on applying for grants, benefits or services, and must promote events recognising wounded or disabled veterans.
  7. 7The department is required to promulgate administrative regulations to carry out the section, so ask which regulation governs the point you are arguing about.

CorrectionThe programme is easy to mistake for an advisory body because most of the section reads as review and recommendation. The operative duty is in subsection (1)(b)2 and it is not advisory: the programme shall ensure that wounded or disabled veterans receive the benefits to which they are entitled.
Worth knowingThe confidentiality provision cuts both ways and is worth understanding before consenting. Subsection (5) lets the coordinator obtain personal information only with consent and only for implementing the programme, and shields it from public disclosure under KRS 61.878 — but the consent is what opens the file in the first place.
Worth knowingThere is no rating threshold anywhere in the section. It speaks of "wounded or disabled veterans" without importing a VA percentage, so a veteran with an unadjudicated or low-rated condition is not excluded by the words of the statute.
