Private Employers MAY Give Veterans a Hiring Preference — and It Is Lawful When They Do

Alabama law lets a private employer adopt a written veterans preference policy, and makes that preference lawful rather than discriminatory. It authorises; it does not require. There is no agency to apply to and no entitlement to claim — what this gives you is a reason to ask an employer whether they have such a policy, and a statute to point at if they say they cannot lawfully have one.

What this benefit is

Alabama law lets a private employer adopt a written veterans preference policy, and makes that preference lawful rather than discriminatory. It authorises; it does not require. There is no agency to apply to and no entitlement to claim — what this gives you is a reason to ask an employer whether they have such a policy, and a statute to point at if they say they cannot lawfully have one.

What it's worth: A lawful hiring preference at private employers that have adopted one

  • Ala. Code 25-1-50 to 25-1-52 AUTHORISE a private employer to adopt a written veterans preference policy. They do not require it.
  • The practical effect is that an employer who wants to prefer veterans may lawfully do so, and cannot be told the preference is unlawful discrimination.
  • There is no agency, no application and no entitlement. This is an enabling law.
  • Its value to you is knowing to ask an employer whether they have a policy — and having a statute to cite if they believe they may not adopt one.

Who is entitled to it

  • You served in the U.S. armed forces.
  • Your home is in Alabama.

Not sure whether that describes you?

Answer a few questions about this benefit specifically — we only ask what this one actually depends on, and we stop as soon as we know.

How to claim it

  1. 1Ask the employer directly whether they have adopted a written veterans preference policy. Many that would have not thought about it.
  2. 2If an employer says a veterans preference would be unlawful, point them at Ala. Code 25-1-50 to 25-1-52, which makes it lawful.
  3. 3Say you are a veteran on the application. A policy is no use to an employer who does not know it applies to you.
  4. 4Do not expect an entitlement. This is an authorisation for employers, and the decision remains theirs.

Worth knowingThis is an authorisation, not an entitlement. It was recorded at MEDIUM confidence in the audit for that reason, and the record says so in its first sentence rather than in a footnote.

Sources

Why only one source type: There is no administering agency and so no operating page — the policies are adopted by individual private employers, and the enabling statute is the whole of the public record.
