Disabled Parking in Wyoming — a Medical Test With No Veteran Route, and the DV Plate Does Not Park

Wyo. Stat. § 31-2-213 was read in full this session. The placard turns on a practitioner’s letter and a twelve-month walking impairment, and there is no veteran shortcut anywhere in it. The disabled veteran plate under § 31-2-215 carries no international symbol of access, which is what the section defines a parking plate as.

§ 31-2-213(c): the department issues a special tamper resistant removable windshield placard to an applicant submitting a letter from his physician, advanced practice registered nurse, physician assistant, physical therapist, occupational therapist, podiatrist or optometrist stating that the applicant has a disability expected to last a minimum of twelve months which limits or impairs the ability to walk. A person responsible for the regular transportation of an eligible person may submit such a letter on their behalf.
§ 31-2-213(c) further provides that "Upon request, one (1) additional placard shall be issued to applicants who have not been issued special license plates."
§ 31-2-213(d)(ii) defines "eligible person" and lists the qualifying limitations: inability to walk 200 feet without stopping to rest; inability to walk without a brace, cane, crutch, another person, prosthetic device, wheelchair or other assistive device; lung disease restricting forced expiratory volume for one second below one litre or arterial oxygen tension below 60 mm/hg on room air at rest; use of portable oxygen; a cardiac condition classified class III or class IV on American Heart Association standards; severe limitation on walking due to an arthritic, neurological or orthopedic condition; or a severe visual or audio impairment that limits mobility.
§ 31-2-213(d)(iii) defines "special license plate" as a licence plate that displays the international symbol of access in a contrasting colour, with the county number, the bucking horse and rider emblem and a distinctive combination of up to three numbers and letters.
§ 31-2-215, the disabled veteran licence plate section, was read in full in the same document. It provides for plates bearing a distinctive symbol or letters identifying the registrant as a disabled veteran, for a veteran receiving 50 percent or more service connected disability compensation who is a resident. It does not provide for the international symbol of access and it says nothing about parking.
Neither section makes a VA disability rating, a disabled veteran plate or a service-connected condition a route into the placard.

How to claim it

1Do not rely on your disabled veteran plate for accessible parking. The Wyoming plate that parks is defined by the international symbol of access, and the disabled veteran plate under § 31-2-215 does not carry it.
2Get the practitioner letter. The statute is unusually broad about who may write it: a physician, an advanced practice registered nurse, a physician assistant, a physical therapist, an occupational therapist, a podiatrist or an optometrist.
3The letter has to say two things — that the disability limits or impairs the ability to walk, and that it is expected to last at least twelve months.
4Read the list of qualifying limitations in subsection (d)(ii) with the practitioner before the appointment. Several of them are objective thresholds a routine letter will not address.
5Ask for the second placard. The statute says one additional placard shall be issued on request to an applicant who has not been issued special plates.
6A carer can apply on your behalf. The section allows a person responsible for the regular transportation of an eligible person to submit the letter for them.
7If your service-connected condition meets one of the listed limitations, that is the route in — it just gets there through the practitioner rather than through the rating.

CorrectionA 100 percent rating does not open a Wyoming placard on its own. The statute asks a practitioner to state that walking is limited or impaired and that the limitation will last at least twelve months, and it gives no shortcut for a rating letter.

Worth knowingThe practitioner list is the most useful thing here. An optometrist and a physical therapist can both write the letter, which matters where a severe visual impairment or a mobility limitation is the qualifying condition and no physician appointment is available.
