What it's worth: A veteran’s benefit, exempt without a dollar limit

  • Subsection (A)(11) exempts "the debtor’s right to receive or property that is traceable to" the listed items, and item (b) is "a veteran’s benefit".
  • No dollar cap appears against item (b), and the "reasonably necessary for the support of the debtor and any dependent" qualifier is not part of subsection (A)(11) as printed.
  • Item (c) of the same subsection covers a disability benefit and is expressly subject to Section 15-41-33, which item (b) is not.
  • The section was last amended by 2017 Act No. 69, effective 19 May 2017.

How to claim it

  1. 1Claim the exemption the moment papers arrive. It is not automatic and it is routinely lost by doing nothing.
  2. 2Cite item (b) specifically. A creditor who reads only item (c) will tell you the exemption is limited by Section 15-41-33 — that cross-reference is attached to disability benefits, not to a veteran’s benefit.
  3. 3Keep the benefit money identifiable. The exemption covers the right to receive it and property traceable to it, and traceability is easier from a dedicated account.
  4. 4Bring a VA benefit summary letter to show the source of the funds without disclosing a diagnosis.
  5. 5Use it in bankruptcy as well as in collection. This is the state exemption schedule, and it applies there too.
  6. 6Federal protection for VA compensation is separate and broader. Claim both.
