How to claim it

Deadline: As early in the case as possible — ask at the first hearing
  1. 1Raise it with your defence attorney at the first opportunity. The court publishes a Request to Participate and separate Entrance Procedures, and both run through the case rather than around it.
  2. 2Understand who has to agree. The court describes a partnership among Superior Court 7, the U.S. Department of Veterans Affairs, county law enforcement, the prosecutor, defence attorneys, the probation department and community corrections — this is a non-adversarial model in which the prosecutor and the defence work with the judge.
  3. 3Check the two eligibility layers. The court states it serves offenders eligible under Ind. Code 33-23-16 AND under criteria for admission established by the court itself. Meeting the statute is not the whole test.
  4. 4Budget the time honestly. The programme lasts 14 to 24 months depending on individual needs, across five phases: acute stabilisation, clinical stabilisation, pro-social habilitation, adaptive habilitation and continuing care.
  5. 5Expect what the court says it asks for: an intense multiphase treatment programme, frequent substance abuse and alcohol testing, intense monitoring, significant education, participation in community programmes, and frequent appearances before the judge.
  6. 6Ask for the Participant Handbook before agreeing. The court states the detail of the five phases lives there rather than on the public page.
  7. 7If you are outside Hamilton County, ask your own county whether it runs a problem-solving court certified by the Judicial Conference of Indiana — the statute is statewide even though this docket is not.

CorrectionThe docket moved. It began in February 2015 in one court and sits in Superior Court 7 since 2023 — a veteran working from an older reference will be sent to the wrong courtroom.
Worth knowingCertification matters. The court submits to certification procedures and requirements established by the Judicial Conference of Indiana and the Indiana Judicial Center, which is why the admission criteria can be tighter than the statute alone.
