05 Apr VA Extends Help To LGBTQ+ Veterans: Can This Be Helpful?
After Obergefell v. Hodges Supreme Court decision in 2015, some survivors of LGBTQ+ Veterans were unable to get married and, as a result, were not legally wed to their now-deceased Veteran spouses for the required amount of time to be eligible for survivor benefits. VA has now announced that it is closing this gap in benefits for these survivors.
Despite being in “marriage-type” relationships long before Obergefell v. Hodges (6/26/2015), many LGBTQ+ veterans could not marry due to laws prohibiting same-sex unions. As a result, many survivors of those LGBTQ+ Veterans were wrongfully denied the opportunity to receive survivor benefits since their Veteran spouse passed away before the marriage had the required length.
